Terms of Service

These terms cover the NexTurn app, this website, and NexTurn hardware. Purchases from the store at shop.nexturn.app also follow the store's own policies, linked in Section 8.

1. Acceptance of Terms

By downloading, installing, or using the NexTurn mobile application, the NexTurn website at nexturn.app (including NexTurn Playtesting), or NexTurn hardware devices (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Drop the Dice LLC ("Company", "we", "us", "our"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use NexTurn. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

4. Permitted Use

You may use NexTurn for personal use and, under the NexTurn Playtesting plans described in Section 10, for game-design and playtesting purposes. You agree not to:

• Reverse engineer, decompile, or disassemble the app or device firmware
• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit harmful, offensive, or misleading content through the Service
• Use automated means to access or interact with the Service

5. User-Generated Content & Conduct

NexTurn lets you create and share content with other users, for example shared game flows, scorepads, setup guides, color palettes, session names, comments, reviews, challenges, player names, usernames, and the playtest sessions, flags, notes, and survey responses you submit to a project's designer ("User Content"). This list is illustrative, not exhaustive.

• We have zero tolerance for objectionable content and abusive users. Objectionable content includes harassment, hate speech, threats, sexually explicit material, content that exploits or endangers minors, spam, and impersonation.
• You are solely responsible for the User Content you share, and you confirm that it complies with these Terms.
• The app provides tools to report objectionable content and to block abusive users. Reports go to our moderation team.
• We review and act on reports of objectionable content within 24 hours, including removing the content and ejecting the user who provided it where warranted.
• We may remove any User Content and suspend or terminate any account that violates this section, at our discretion, with or without notice.

6. Game Data & Content

You retain ownership of the game session data, player names, and other content you create through NexTurn. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you and other users you choose to share it with (e.g., friends).

Aggregated, anonymized game statistics (such as average turn times by player count) may be used to provide global statistics features. No personally identifiable information is included in aggregated data.

7. Third-Party Services

NexTurn allows optional integration with BoardGameGeek (BGG). When you connect to BGG, your interactions with BGG are governed by BGG's own terms and privacy policy. We are not responsible for the practices or content of third-party services.

8. NexTurn Hardware

NexTurn coasters are designed to work with the NexTurn app; some features require the app and an account. We may update device firmware through the app to fix problems or add features.

• Buying coasters. Coasters are sold through our store at shop.nexturn.app. Orders, preorders and batches, pricing, shipping, cancellation, and returns are governed by the store's Terms of Service, Shipping Policy, and Refund Policy, which apply to those purchases alongside these Terms.
• Included app access. A Table Set includes access to the paid features of the NexTurn app. We enable it for the email address on your order when the order is paid. It is part of that purchase and ends if the order is cancelled or refunded. Coasters bought individually do not include it; the app's paid features remain available as the one-time Pro purchase, and connecting four or more NexTurn coasters to one account also unlocks them, as described on the product pages.
• Warranty. Hardware is provided "as is" with a limited warranty covering manufacturing defects for 1 year from the date of delivery. The warranty does not cover damage from misuse, water exposure, or unauthorized modification. Contact support@nexturn.app with your order number to make a warranty claim.

9. NexTurn Playtesting

NexTurn Playtesting lets game designers run private tests of their games and lets testers submit plays and feedback. It is an optional part of the Service and is subject to these Terms.

• Designers are solely responsible for the games, rules, files, and other materials they distribute to testers, and represent that they hold the rights needed to share them. You may not use Playtesting to distribute content that infringes others' rights or that violates Section 5. NexTurn does not send invitation emails: an email invitation opens as a draft in your own email app and you send it from your own email account. It must still follow Section 5.
• Testers, including anyone who joins a playtest table from their own phone, may receive access to unreleased, confidential material. You agree to use it only to playtest and give feedback, and not to copy, publish, stream, sell, or otherwise redistribute a designer's game or materials without their permission.
• When you submit plays or feedback to a project, that data is shared with the project's designer and their team, who may view and export it, as described in our Privacy Policy. Do not submit anything you consider confidential to yourself.
• Feedback you submit may be used by the designer to develop and improve their game.

10. Subscriptions, Trials & Billing

Some parts of the Service, currently the Playtesting Designer and Studio plans, are offered as paid subscriptions, billed through our payment processor, Stripe. The NexTurn mobile app's Pro unlock is a one-time purchase, not a subscription, and is not covered by this section except as described under "App trial" below. Pro is a license to use the app's paid features, not ownership of the app; Section 13 covers what happens to it if the Service shuts down. Device orders are covered by Section 8 and the store's policies.

• App trial. NexTurn app accounts may be offered a free, time-limited trial of the app's Pro features, which you can choose to activate once from within the app. The trial begins when you activate it, runs continuously, and cannot be paused or restarted. No payment method is required and nothing is charged when the trial ends; the account simply returns to the free tier, and games recorded during the trial are preserved and become available again if you later purchase the Pro unlock. Trials are limited to one per person, and we may decline, shorten, revoke, or discontinue trials at our discretion, including where we detect repeated trial signups.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period (for example, each year) at the then-current price, using your saved payment method, until you cancel.
• Free trials. A subscription may begin with a free trial. If you do not cancel before the trial ends, the subscription converts to paid and your payment method is charged. Trials are limited to one per person, and we may decline or shorten a trial where we detect repeated trial signups.
• Cancelling. You can cancel at any time through the billing portal linked in the app or on nexturn.app. When you cancel, you keep access through the end of the period you have already paid for, and it does not renew after that. A lapsed subscription keeps your existing playtest projects and reports, but cannot create new projects or sessions until you resubscribe.
• Pro licenses. Annual Designer and Studio plans include a number of NexTurn Pro licenses you can assign to others, available once any free trial converts to a paid subscription; additional licenses can be purchased. A license is an optional gift of the NexTurn app’s Pro features for its holder’s own use. It is not required to take part in a playtest, and testers can play and give feedback without one. Once assigned, a license is a one-time unlock that remains active for its holder even if your subscription later ends (subject to Section 13), and it cannot be taken back or moved to someone else.
• Price changes. We may change subscription prices. Changes apply to future billing periods, and we will give notice before your subscription renews at a new price.
• Refunds. Except where required by law or described in Section 13, payments under this section are non-refundable. Purchases made through the App Store or Google Play are subject to those stores' own refund policies. Device orders follow the store's Refund Policy.

11. Intellectual Property

The NexTurn app, brand, logo, device design, and all related intellectual property are owned by Drop the Dice LLC. Game names, cover art, and related content referenced within the app belong to their respective rights holders and are used for identification purposes only.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT FOR THE HARDWARE WARRANTY STATED IN SECTION 8. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Changing or Shutting Down the Service

We may add, change, suspend, or remove features of the Service, including paid features, at any time. Except as this section provides, we are not liable to you or any third party for modifying, suspending, or discontinuing the Service or any feature of it.

If we decide to shut down NexTurn's online services entirely:

• Advance notice. We will announce it at least six months before they stop, on nexturn.app, in the app, and by email to account holders and subscribers, unless the law or events outside our reasonable control force a faster stop.
• Sales. When we announce it, we will stop selling Pro, stop new Playtesting subscriptions, and stop renewing existing ones for any period running past the shutdown date. If we keep selling coasters after the announcement, the listing will say so plainly.
• Subscriptions. Playtesting subscribers receive a prorated refund for paid time that runs past the shutdown date.
• Your data. You can delete your account, and export your Playtesting projects and reports, at any time before the shutdown date; afterward we delete the data on our servers as described in our Privacy Policy.

What stops, and what can keep working. Everything that relies on our servers stops with them, including sign-in, sync, live multi-phone games and join codes, friends, community content, stats, BoardGameGeek import, Playtesting projects and reports, push notifications, purchases, and updates. Pro, however you received it (bought in the app, included with a Table Set, given as a Playtesting Pro license, or granted by us as a trial, promotion, or comp), is a license to use the app's paid features for as long as we operate the Service (and in any final version described below). It is not a subscription, but it does not outlast the Service. The coasters connect to the app over Bluetooth and do not connect to our servers themselves. If we shut down, we intend to release a final version of the app that runs the coasters and the app's core game features on your phone without an account or our servers. We can't guarantee that version, and like any app that is no longer updated, it may eventually stop working with new phone software or become unavailable in app stores. Either way, we will make the code we own that is necessary for the coasters to keep working (how the app connects to and controls them) open source, so that others can build apps for them. We will do that before the online services stop, or as soon afterward as we reasonably can if a faster stop is forced on us.

If a court, an insolvency process, or another legal requirement prevents us from doing something in this section, we will do as much of it as we lawfully can.

Nothing in this section limits rights you have under consumer protection law that cannot be waived.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DROP THE DICE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE, OR FOR THE PRODUCT GIVING RISE TO THE CLAIM, IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account yourself, at any time, in the app: Settings → your account → Delete Account. Deletion is immediate and cannot be undone; our Privacy Policy describes what is removed and what is kept. Upon termination, your right to use the Service ceases immediately.

16. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of Tennessee.

17. Changes to Terms

We may update these Terms from time to time. Changes will be reflected in the "Last Updated" date above. Continued use of NexTurn after changes constitutes acceptance of the updated Terms.
